Protest Against Diluting UP RERA Rules

UP flat owners call for reversal of RERA dilution

The Flat Owners Federation of Ghaziabad gave a call to the UP Government to withdraw its move to dilute the UP RERA Rules and to appoint a permanent RERA Authority. Otherwise its repercussions will be seen in 2019, the Federation warned at a General Body meeting.

The President, Col. Tejandra Pal Tyagi stressed that  despite the fact that two years have already passed since the enactment of RERA, the UP Government is yet to appoint a permanent Real Estate Regulatory Authority.

"Furthermore, it has also come to our notice that there is no tab to check the cause list and judgements passed by RERA in the web site of UP RERA, which clearly indicates that the UP RERA is yet to become fully operational. The officers nominated to the Interim Regulatory Authorities are responsible for their own departments as well and hence they cannot devote much time", he added.

The ASSOCHAM has recommended in their report that Permanent Regulatory Authority for RERA should be nominated by state without any further delay whatsoever. Now, when the builders want it and when the Home Buyers are already asking for it, then what is the delay? Further, the officers may have to be strictly answerable for delay in giving Ownership Title, Land Use Conversion, Environment NOC, Pollution NOC, Non Encumbrance Certificate, Occupancy Certificate, Municipal Services permission.

Vice Presidents of Flat Owners Federation, Shri M K Machama, Shri R K Garg and Secy Mukesh Agrawal said that since Uttar Pradesh is a big state and  the bulk of the ongoing projects are situated in Noida/Ghaziabad region, it is desirable to set up a branch of UP RERA in Noida/Ghaziabad region.

Shri C M Vaid, Shri Gaurav Mittal, Shri P S Singh, Smt Anuranjana Tyagi and Shri Mendiratta have brought out in their talk that they have raised the issue of dilution in the Real Estate rules notified by erstwhile Government in the favour of real estate Developers by notification no.1438 dated 27 Oct 2016. It may further be noted that the Governor of UP had also written in Oct 2016 to the then Chief Minister of UP to re-consider the dilution of rules. It may also be noted that that “Completion Certificate” is not included in 32 items of section 84(2) of the RERA Act on which the States can make rules, then how come the State has diluted norms on Completion Certificate?

It was unanimously decided to write a letter to the Chief Minister of UP Govt  with a request to take corrective actions, failing which the Home Buyers may go for a wider protest.
